1. The Milya-store.co.il website (hereinafter: " the Website/Business ") serves as a consumer store for the purchase of various products by the browsing public in Israel via the Internet.
2. The provisions of these Terms and Conditions shall apply to any use made by a user and/or person performing an action on the Site (hereinafter: " the Customer ") and to any order placed by the Customer through the Site. Therefore, each Customer is requested to read these Terms and Conditions in their entirety and carefully and to commit to their terms.
3. Any action on the site, including the purchase of products offered for sale on the site, constitutes the customer's agreement to accept the provisions of these regulations and to act in accordance with them.
4. The regulations are written in the masculine gender for convenience only, but they also apply to women.
5. The regulations are formulated in the singular, for convenience only, but they also refer to the plural.
6.  Order on site

1. All prices and/or products and/or benefits appearing on the site are valid as long as they appear on the site. Only , and the customer will not have any claim and/or claim for any contradiction and/or inconsistency between the prices and/or products and/or benefits that appear on the site at that time and what he saw some time before and has not yet placed any order.

7. Payment on the site will be made by credit card or Paypal. The credit cards accepted on the site are: American Express, Isracard and Visa. Purchases on the site cannot be made using checks, purchase orders, gift cards, gift certificates, reloadable cards, coupons and credits, with the exception of credits and/or gift vouchers that can be redeemed on the site only.
8. If the customer chooses to pay with Bit, first of all, they must contact the business directly to place the order and pay via the app. If payment is not made within 24 hours, the order will be canceled .
9. When placing an order on the site, the business will check the credit card details and upon confirmation of the order by the credit card companies, an appropriate notification will be given that the operation has been approved or rejected. If approved, the order will be recorded on the business's computers and the customer will be sent confirmation by e-mail and/or SMS message that the operation has been carried out. It is clarified and emphasized that only confirmation of the order received by the customer's e-mail, which includes the relevant order details, including the order number, customer details and order details, will constitute confirmation of receipt of the order by the business. Order acceptance options

1. Home deliveries.
2. At a cost of 35 NIS for shipping.
3. Delivery is made within 3 business days from the date the order is placed on the site.
4. Shipments intended for distribution in areas where courier mail does not reach will be sent via Israel Post registered mail.

Cancel order

1. Order cancellation policy will be subject to the provisions of the Consumer Protection Law, 5741-1981 (hereinafter: " Consumer Protection Law") .
2. You can cancel an order to purchase a product from the date of the order up to 14 days from the date of actual receipt of the product or from the date of receipt of the order confirmation - whichever is later, if the packaging has not been opened.
3. The right of cancellation is not valid, among other things, in the following cases:
   • Goods manufactured specifically for the customer.
   • Perishable goods (perishable or perishable products such as food products that have passed their expiration date, etc.).
4. Cancellation of an order before the product is shipped to the customer will be done as detailed below. The cancellation will only take effect upon confirmation of receipt of the message by the business, provided that the order has not yet been shipped to the customer.
5. To cancel an order, please contact the business as soon as possible.

• Canceling an order after the product has been delivered to the customer will be done as follows :

The purchaser must contact the company and return the products, in their original and complete packaging (if packaged), within 14 days of receiving them, and receive a credit for them. In such a case, the purchaser will bear the full cost of shipping the products from the company to the purchaser and from the purchaser to the company. In addition, the company will charge the purchaser a cancellation fee at the rate/amount of the lower of 5% of the cost of the products purchased or 100 NIS, in relation to each such cancellation. The company will be entitled to deduct the said amount from the payment that will be refunded to the purchaser after the product is returned to the company as aforesaid.

(a). The customer will act to cancel the order as soon as possible, no later than 14 days from the date of receipt of the product;

(b). The customer will be credited upon completion of the processing of the request within 14 days from the date of receipt of the cancellation request, subject to the return of the product to the store. The return of the product will be at the customer's expense (shipping cost) to the address 53 Be'eri Street, Netanya, or by coordinating the collection of the product from the customer's home;

(c). Upon crediting, the customer will be given a copy of the cancellation notice as aforesaid and the store will be entitled, at its sole discretion, to charge the customer an order cancellation fee in accordance with the provisions of the Consumer Protection Law and will inform the customer of its decision regarding the charge before actually charging the customer. The cancellation fee will be up to 5% of the purchase price or 100 NIS, whichever is higher.

It is clarified that cancellation of such an order will be made upon presentation of an invoice or credit card details with which the order was made, and if none of the above is presented, the financial credit will be in accordance with the lowest price of the product in the last 14 days.

1. In the event of an order cancellation for any reason, the customer will allow the store and/or someone on its behalf to forward his name and address to the manufacturer or importer of the product for inspection .
2. If, after placing an order on the site, it becomes apparent that the product is out of stock and/or that it cannot be delivered, the customer will receive an e-mail (or the store representative will contact him by telephone) informing him of the cancellation of the order for that product without charge and/or a refund (as applicable) and the customer will not have any claim against the store in this regard. Alternatively, Milia Store may offer the customer an alternative product, equivalent in value to the product ordered. The customer will be given the right to choose whether he is interested in the alternative product or whether he is interested in canceling the order for that product without charge and/or a refund of his money to the extent owed (as applicable). The customer will not have any claim and/or demand and/or claim of any kind against the store in the aforementioned case.
3. If, after the order has been delivered to the customer, it becomes apparent that not all of the products in the order have been delivered to the customer, the customer shall contact the store no later than 7 business days from the date of delivery of the order. The customer shall be given the right to choose whether: (a) he wishes to be refunded for the product(s) that were not delivered; or (b) he wishes to collect the missing product(s) or a replacement product. The customer shall not have any claim and/or demand and/or claim of any kind against the store in the aforementioned case.
4. Products that are displayed at promotional prices will be supplied at the promotional price, subject to the promotion being valid at the time of ordering on the site and the availability of the product in the company's inventory.
5. Products from the "Last Chance" category cannot be exchanged for another product. In the event of a return of a product from the "Last Chance" category, a monetary credit will be given only, based on the price paid by the customer when ordering/purchasing the product and against a purchase invoice.
6. The store may discontinue the site's operations and/or its ordering mechanism at any time.

• Confidentiality and privacy

1. The customer declares and agrees that the provision of his personal details in the order form is done according to his wishes and with his consent, and filling in the details indicates his consent to their provision.
2. The data that the customer provides during registration will be stored in the Milia Store database (except for credit card details). It is hereby clarified to the customer that he is not required by law to provide the information , but without providing it, he may not be able to use the ordering services on the site.
3. When using the site, information may be accumulated about the customer's purchasing habits and practices, products and services that he purchased or requested to return, information about advertisements in which he expressed interest, pages or departments that he viewed, offers and services that interested him, payment methods that he used, and more. The store will store the information in its databases (except for credit card details). The use of this data, as well as the data that you provide during the registration process for the various services on the site, will be done only in accordance with the provisions of this document or in accordance with the provisions of any law. Milia Store will use the above data for the purpose of anonymous statistical analysis and segmentation, as well as to create for each user the content (offers/coupons/messages) that are relevant to him.
4. The store will not transfer to third parties, who are not affiliated companies of Milia Store or entities acting on its behalf, the customer's personal details and the information collected about his activity on the site (insofar as this details and information personally identify him), except in the following cases:
   1. In the event that he violated the terms of use of the site, or if he committed, through the site, or in connection with it, actions that are deemed to be contrary to the law, or attempted to commit such actions.
   2. In accordance with the provisions of a court order instructing Milia Store to provide details or information about the customer to a third party, even if it is not the court.
   3. Any dispute, claim, lawsuit, demand or legal proceedings, as they may arise, between the customer and Milia Store (including affiliated companies and/or anyone on its behalf).
   4. In any case where, in the opinion of Milia Store, the provision of information is necessary to prevent serious harm to the customer's body or property.
   5. Milia Store will be entitled to provide the customer's information to the credit company required to approve the execution of the order transaction as stated.

• responsibility

1. Responsibility for the quality of a product applies to its manufacturer and/or importer according to the Consumer Protection Law and various regulations enacted pursuant to it. Subject to all laws.
2. Everything that appears on the site, including commercial offers and/or advertising by third parties (hereinafter: " the Information "), regarding the various products, and in general, is general information only. The information should not be considered a guarantee of any result and/or a guarantee for the operation of the products. The store will not be liable for any damage, direct or indirect, that may result from reliance on the information and/or links to other sites and/or any other internal/external source of information.
3. Milia Store will not be responsible for any problems that may arise as a result of using the site, including: malfunctions in the operating system and/or any software found on the electronic device from which the site was accessed and/or any hardware problem and/or viruses and/or hostile software or any other software that may be discovered or found on the electronic device from which the site was accessed as a result of using the site and/or any communication or data transfer problem that may temporarily or permanently prevent the use of the site and/or the quality or speed of use of the site.

• Intellectual property

1. All copyrights and intellectual property rights on the site, including any content contained therein, belong solely to Milia Store, or to a third party that has authorized the store to use them. You may not copy, distribute, publicly display, publicly perform, transmit to the public, modify, process, create derivative works, sell or rent any part of the above, either directly or indirectly, through a third party, or by any means or means, whether electronic, mechanical, optical, photographic or recording, and the like, without obtaining prior written consent from Milia Store or the other rights holders, as the case may be and subject to the terms of the consent (to the extent given).
